Leasehold Enfranchisement

Leasehold enfranchisement is a fancy name for tenants’ statutory rights to extend their long residential leases. Collective enfranchisement describes tenants’ rights to buy the freehold title to those leases from their landlord.

We act for landlords and tenants in these matters, advising on the statutory procedure, their eligibility, how and when to instruct valuers and the most effective strategies to get the best outcome.

We have acted for landlords and tenants with a broad range of properties and values – from single leases to large developments.

Work scope

  • Advising on statutory eligibility, serving statutory notices to activate the process, advising on tactics to agree terms quickly and effectively, protecting the parties’ interests at the land registry, advising on the terms of the new extended lease and improving other terms of the lease, corresponding with lenders as necessary, applying to and attending the Leasehold Valuation Tribunal and making court applications to protect the parties’ rights, advising where the landlord is absent or insolvent.
  • In addition re buying the freehold; advising on who will actually buy it (the tenants themselves or a company set up by them).
